What Earlybirdo is
Earlybirdo is operated by Ajolla Inc., 802 Four Seasons Blvd., Aurora, IL 60504. It is a pre-order platform: creators list things that aren’t ready yet, with a fixed number of spots, a price, an estimated delivery date and a refund policy, and customers order them ahead of launch.
Earlybirdo is not crowdfunding. There are no funding goals, donations, pledges, rewards for support, investment or equity. Every order is a purchase of a specific thing the creator promises to deliver.
Who sells to you
The creator named on each campaign is the seller and merchant of record. Your contract for the item is with them, and they are responsible for delivering it, for its quality and for refunds. Payments go directly to the creator’s Stripe account. Earlybirdo is not the seller, does not hold your money and takes no commission on orders.
Ordering
You must be 18 or older. When you pre-order you’re shown the price, the estimated delivery date, when you’ll be charged and the refund policy. Those terms are saved with your order and can’t be changed afterwards.
Some campaigns charge you at checkout. Others save your card with Stripe and charge it only when your order is ready, no more than 14 days before the estimated delivery date. A campaign more than 180 days from delivery must use the second way.
Delays and refunds
If a creator can’t meet the estimated date, they must tell you before it passes and give a new date. You can always cancel for a full refund instead. If the new date is more than 30 days later, or it’s a second delay, your order is cancelled and refunded unless you tell us you want to wait.
If delivery is late and you haven’t agreed to wait, you can cancel for a full refund straight away, whatever the campaign’s refund policy. Read the Refund Policy for the details.
Creators
Creators must verify their identity with Stripe Identity ($1.50, once), connect a Stripe account in their own name, follow the Seller Rules and pay for a plan to publish campaigns. Creators agree to Stripe’s Connected Account Agreement.
Conduct and removal
Don’t list anything the Seller Rules prohibit, mislead customers, harass anyone or try to take payment outside Earlybirdo. We can remove campaigns, cancel and refund orders, and suspend accounts that break these terms.
Liability
To the extent the law allows, Ajolla Inc. isn’t liable for a creator’s failure to deliver, beyond helping you get the refund you’re owed. Nothing here limits rights you have under consumer law.
